MASTER INTERAGENCY AGREEMENT

This Master Interagency Agreement (IA) is made and entered into by and between the USDI, Bureau of Land Management, Montana; USDI, National Park Service, Intermountain Region; USDI, Fish and Wildlife Service, Regions 1 and 6; USDA, Forest Service Regions 1, 2, 4, & 6, and the states of Montana, Idaho, Washington and Wyoming under the authority of the Economy Act of June 30, 1932 (31 U.S.C. 1535) and the Endangered Species Act of 1973 (16 U.S.C. 1531-1543; 87 Stat. 884).
I. BACKGROUND
Federal Agencies have responsibility for and are directed by the Endangered Species Act (ESA) to utilize their authorities, in cooperation with state and local agencies, to promote the conservation of endangered and threatened species. Listed in 1975, the threatened grizzly bear is one of these species. The Grizzly Bear Recovery Plan, issued initially in 1982 and revised in 1993, outlined several tasks to be implemented to bring the grizzly bear back to the point where protection under the ESA is no longer required. Considerable grizzly bear research, monitoring, and management activities have been undertaken in past years by a myriad of agencies, institutions, and private individuals. In 1983, the Interagency Grizzly Bear Committee (IGBC) was established to help ensure recovery of viable grizzly bear populations and their habitats in the lower 48 States through interagency coordination of policy, planning, management, and research. One of the objectives of the IGBC is to coordinate management and research actions of State and Federal Agencies related to the grizzly bear to ensure the best utilization of available resources, and prevent duplication of effort.
On June 7, 2005, parties to this IA along with the State wildlife agencies from the States of Idaho, Montana, Washington and Wyoming entered into a Memorandum of Understanding
(FS # 05-MU-11015600-071) for the purpose of documenting a framework of cooperation between the parties involved in the IGBC. This replaces the previous Memorandum of Understanding
(FS # 00-MU-11015600-006) which expired in 2005.
II. PURPOSE
To authorize the transfer of funds between the parties to this IA in order to jointly finance grizzly bear research, monitoring, and management projects approved by the IGBC.
III. IT IS MUTUALLY AGREED AND UNDERSTOOD BY AND BETWEEN THE PARTIES THAT:
A. The principal contacts for this IA are listed in Exhibit A.
B. Funds may be transferred between the parties to this IA in support of approved projects by means of an IGBC approved Project Work Plan (see Exhibit B for a sample). Approved Project Work Plan(s) added to this IA shall be executed and have fund transfers completed within the duration of this IA (see Provision III-J). Each approved Project Work Plan shall at a minimum contain:
1. A specific numbering sequence.
2. Specific language stating that the Project Work Plan is being added to this IA.
3. Project description of services to be performed with specifics including contacts, equipment, supplies, time frames, detailed financial plan, etc.
4. Specific instruction as to the method(s) of fund transfer between the parties.
5. Signature of authorized official(s) of the Federal agency(ies) requesting that services be provided and funds be transferred. The Project Work Plan must also include a signature of authorized official(s) of the Federal agency(ies) accepting the funds for performing such services. Such officials must have the authority to enter into this Project Work Plan and the financial capability to fund their agency’s portion of the project or perform such services.
6. Approval of the IGBC Chairman.
C. Approved projects to be added to this IA may include, but are not limited to, monitoring of grizzly bear populations; habitat inventory and mapping; aerial surveys; management studies; purchase of equipment such as radio collars, radio receivers, and trapping and handling supplies; vehicle costs; preparation and distribution of reports; purchase of exhibits; and development or support for educational exhibits and programs; and other items that might assist in recovering the bear.
D. Approved Project Work Plan activities carried out under this IA will be under the supervision of the designated lead agency personnel and under the overall guidance of the IGBC.
E. Modifications within the scope of this IA shall be made by mutual consent of the parties, by the issuance of a written modification, signed and dated by all parties, prior to any changes being performed. No party is obligated to fund any changes not properly approved in advance.
F. Give any party to this IA or the Comptroller General, through any authorized representative, access to and the right to examine all books, papers, or documents related to this IA.
G. Nothing herein shall be considered as obligating any party to expend or as involving the United States in any contract or other obligations for the future payment of money in excess of funding approved and made available for payment under this IA and modifications thereto.
H. Once executed this IA replaces the Interagency Agreement dated June 21, 2000, between the following Federal agencies:

I. Any party, in writing, may terminate this IA in whole, or in part, at any time before the date of expiration. No party shall incur any new obligations for the terminated portion of this IA after the effective date and shall cancel as many obligations as is possible. Full credit shall be allowed for each party’s expenses and all non-cancelable obligations properly incurred up to the effective date of termination.
J. This IA is executed as of the last date shown below and expires five years thereafter, at which time it will be subject to review, renewal, or expiration.
The authority and format of this IA have been reviewed and approved for signature by a Forest Service Agreements Coordinator.
